In TRAC's previous report on detainers issued by U.S. Immigration and Customs Enforcement (ICE) agents between FY 2008 and FY 2012, it was noted that detainers had been placed on 834 U.S. Citizens and 28,489 legal permanent residents (LPRs, or "green card" holders). The information provided by ICE on the detainers issued did not include the names of the individuals or the state in which each detention facility was located. However, additional research and investigation has enabled TRAC to identify the state for most (though not all) detainers. Table 1 contains the list of states and counts of the numbers of U.S. citizens against whom detainers were issued, and an indication of whether or not they had been convicted of any crime. Note that these are undercounts, due to the number of facilities for which state location could not be determined from the information ICE provided. Table 2 provides detainer counts by facility location for U.S. citizens.

Similarly, TRAC was able to determine the states associated with most detainers issued against legal permanent residents. See Table 3. Again, these are undercounts, due to the number of facilities for which state location could not be determined from the information ICE provided. Table 4 provides detainer counts by facility location for LPRs.

An immigration "detainer," often called an "immigration hold," is a notice that Department of Homeland Security (DHS) agents issue to local, state and federal law enforcement agencies. It is a primary tool ICE uses to apprehend suspected noncitizens being held by these authorities. These results are based on TRAC's analysis of case-by-case records on nearly one million detainers issued by ICE between FY 2008 and the start of FY 2012 The information was obtained from ICE by TRAC through a Freedom of Information Act request.
