The vast majority of aliens apprehended by Border Patrol unlawfully entering the United States are not prosecuted for the criminal offense of unlawful entry, but are instead either formally removed or permitted to depart voluntarily in lieu of removal. This is largely because pursuing criminal charges in
all cases would place a heavy burden upon
prosecutorial resources and detention facilities. In recent years, the percentage of persons prosecuted for unlawful entry or reentry has grown considerably, but most aliens apprehended by
Border Patrol who are attempting to enter the
country unlawfully are removed from the United States without criminal sanction.....[Citing TRAC research].
