Local Immigration Prosecution: A Study of Arizona Before SB 1070

Immigration already constitutes the number one most prosecuted crime category in the federal system, overtaking other staples, such as narcotics, white collar fraud, and weapons offenses. In Arizona, where the lion’s share of the nation’s criminal immigration cases is prosecuted,overflow has become so severe that a judicial state of emergency was recently declared. The lack of sufficient judicial resources to meet the explosion in federal caseload may be part of the driving force away from more complex smuggling cases and toward simple illegal entry and reentry prosecutions.........[citing TRAC research].
