Report | A Legacy of Injustice: The U.S. Criminalization of Migration

NIJC submitted numerous requests under the Freedom of Information Act (FOIA) to the De-partment of Homeland Security, Immigration and Customs Enforcement, Customs and Border Protection, and the Department of Justice, for information to inform this report. We continue to appeal the requests that have been denied and pursue open requests. Records providing informa-tion about the Trump administration’s “Zero-Toler-ance” policy were obtained through FOIA requests filed in conjunction with the American Immigration Council and other partner organizations. This report also relied on publicly available data and reports from the U.S. Sentencing Commission, the Administrative Office of the U.S. Courts, the Executive Office of U.S. Attorneys, the Bureau of Prisons, and the Bureau of Justice Statistics, as well as data from the Transactional Records Access Clearinghouse.....[Citing TRAC data and reports].
