4th Circ. Strikes Down Limits On Immigration Case Closures

In addition to provisional waiver cases, immigration judges may also grant a request to table removal proceedings in cases where the foreign citizen is waiting for other relief from U.S. Citizenship and Immigration Services, including certain humanitarian visas and special immigrant protections, or where the foreign citizen may be eligible for deferred action, such as through the Deferred Action for Childhood Arrivals program. Winograd also pointed to the immigration court backlog, which climbed past 975,000 pending cases, according to data from the Transactional Records Access Clearinghouse at Syracuse University.
