A possible factor in the low approval of defensive asylum applications is that non-citizens in immigration court are not afforded the right to counsel; data from Syracuse University’s Transactional Records Access Clearinghouse (TRAC) shows that between 60% and 80% of those appearing in immigration court who have never been detained are represented by counsel, compared to 10% to 30% of those appearing in immigration court who have been detained appearing with counsel.
