The Obama administration had already explored — and found unfeasible — other options for detention, including amending the Flores agreement, when a surge of Central American immigrants crossed the Southwest border in 2014. The response then was to release parents with a monitoring bracelet and have them check in with immigration officials, something the current administration finds unacceptable, claiming immigrants released rarely show up for their appointments.
However, data from the Transactional Records Access Clearinghouse and the Justice Department show that most immigrants released do appear for required hearings. For example, in Fiscal Year 2015, 86 percent of migrants attended subsequent court hearings, according to TRACC. While in Fiscal Year 2016, 75 percent showed up for court proceedings, according to DOJ records.
