One of the ways that localities become entangled in federal immigration enforcement is through what is known as an immigration detainer, or ICE Form I-247D.7 A detainer is a request that a LEA hold a person for up to 48 additional hours after his or her release date, so that ICE can decide whether to take the person into custody for immigration detention and removal proceedings. Detainers were widely used in the now defunct Secure Communities program,8 which ended in 2014, and they continue to be used in the successor Priority Enforcement Program.
