Despite numerous court decisions ruling against
Defendants, see, e.g., Ortega v. Hodgson, No. 11-cv-10358-MBB, 2011 WL 4103138 (D. Mass. Sept. 13, 2011); Flores-Powell v. Chadbourne, 677 F. Supp. 2d 455 (D. Mass. 2010); Sengkeo v. Horgan, 670 F. Supp. 2d 116 (D. Mass. 2009), the government has remained steadfast to its dubious interpretation of § 1226(c). This has coincided with the government's
expanded focus on detaining criminal-aliens and prolonged delays in immigration litigation.......[citing TRAC research]
