The Case for Mexican Asylum Seekers Fleeing Cartel Violence
By Perry Nava, Barry University, Professor Birdsong, Refugee and Asylum Law

Transactional Records Access Clearinghouse (TRAC) reports on immigration judges covering 2006-2011 lists two judges in El Paso: Judge Thomas C. Roepke, who had a 96.7% rate of denial, and Judge William L. Abbott, who had a 74.6% rate of denial. Both of these judgesí denial rates seem high to begin with, but the great disparity between their rates is of particular concern. Such a wide difference between two judges in the same city suggests an excessive amount of discretion is vested in immigration judges. A system without a proper measuring stick will not produce consistent results........[citing TRAC research].
