The purpose of immigration detention is not to punish people who have violated criminal or immigration laws, but to ensure that immigrants attend all of their immigration court hearings and comply with orders issued by immigration judges. Some immigration detainees have no legal immigration status; others have permanent residence or another type of immigration status, but the government believes it has the legal authority to remove them from the country. Most immigration detainees have no criminal record,or have committed only minor crimes or traffic violations, often many years before being detained by ICE......[citing TRAC research].
