Padilla V. Kentucky: A New Chapter In Supreme Court Jurisprudence on Whether Deportation Constitutes Punishment for Lawful Permanent Residents

Certain immigration violations are prosecuted in federal court. For example, noncitizens may be prosecuted in federal court. For example, noncitizens may be prosecuted for entry at an improper time or place, as well as for reentry into the United States following an order of deportation. The number of prosecutions in federal court is astounding. During the first nine months of fiscal year 2009, there were 40,050 prosecutions for improper time or place entries. That same year, there were 21,892 prosecutions for reentry violations.......[citing TRAC research].
