The Behavior of Federal Judges: A theoretical & Empirical Study of Rational Choice

TRAC provided us with a dataset consisting of sentences imposed in 581,193 federal cases between 2003 and 2011. The cases are sorted into 108 Department of Justice categories. We limited our analysis to the post-Booker cases (2006-2011) in the four largest categories: Drugs-Organized Crime Task Force (that is, organized-crime drug offenses), Drugs-Drug Trafficking (other drug offenses), Weapons-Operation Triggerlock Major (weapons offenses), and Immigraton offenses. Because of random assignment to the judges in each district, there should be no systematic differences between the cases assigned to Rs and Ds in the same category of cases in the same district.
