The Transactional Records Access Clearinghouse (TRAC) has sued the Department of Homeland Security in federal court asking that it order the accelerated production of information that TRAC had previously sought from ICE under the Freedom of Information Act. The lawsuit is being handled with the pro bono support of
Covington and Burling.
Through these FOIA requests, TRAC hopes to obtain specific unpublished information regarding non-citizens with criminal arrests or convictions. ICE has not responded in a substantive way to the FOIA requests. The need for expedited processing increased after the Supreme Court granted certiorari last month in the case of Lopez v. Gonzales.
TRAC hopes that the prompt production of the requested data will help guide the Supreme Court and the parties involved in Lopez.
